Missoula County, located in western Montana and home to the state’s second-largest city, operates a three-court judicial system that processes thousands of cases annually. The Fourth Judicial District Court serves as the county’s court of general jurisdiction, handling felonies, major civil disputes, domestic relations, probate, and juvenile matters. The Missoula County Justice Court and Missoula Municipal Court both exercise limited jurisdiction over misdemeanors, traffic offenses, small claims, and local ordinance violations. The Clerk of District Court maintains official records for more than 5,000 new cases filed each year, along with historical records spanning adoption, criminal, civil, domestic relations, guardianship, juvenile, paternity, probate, and involuntary commitment proceedings.

Individuals looking for Montana court records can begin by exploring the resources available through MontanaCourts.us, which provides links to court locators, self-help resources, legal forms, and public access portals for trial court records. Missoula County records can also be accessed directly through the Clerk of District Court’s office, the Justice Court, or the Municipal Court, depending on where the case was filed. In-person visits, online portals, mail requests, and fax submissions are all accepted methods for obtaining court documents.

Are Court Records Public in Missoula County?

Montana law establishes a broad right of public access to government records, including court files. The Montana Public Records Act (Title 2, Chapter 6, MCA) requires state and local agencies to make records available for public inspection, with certain defined exceptions. Court records in Missoula County follow this framework, and most case filings, dockets, orders, and judgments are open to examination by any member of the public.

What Is Publicly Available

Public court records in Missoula County include new case filings and party names, chronological case summaries, court dockets and calendars (including case numbers, hearing dates, and locations), case status for both pending and closed matters, and claimant and party indexes.

What Is Restricted or Redacted

To protect privacy and prevent identity misuse, the following information is routinely redacted from publicly accessible court documents:

  • Telephone numbers of case parties
  • Home and office addresses
  • Social Security numbers
  • Credit card and financial account information
  • Driver’s license numbers and other personal identification numbers

Certain entire categories of records are also restricted:

  • Juvenile court records — Generally confidential and not available to the public without a court order
  • Sealed and expunged records — Require a court order for inspection
  • Confidential criminal justice information (CCJI) — Information related to ongoing investigations and pending criminal cases is confidential by law and almost always requires a court order for disclosure

Missoula County uses an online public records request portal for general county record requests. However, court-specific record requests should be directed to the Clerk of District Court, Justice Court, or Municipal Court as appropriate.
